Massachusetts Congressman Ed Markey says that regulators should take this into account when considering the merger plans. A bill introduced in the U.S. House of Representatives by Jay Inslee (D - Washington) would legislatively overrule the Copyright Royalty Board's decision to increase the fees paid by webcasters. The new bill would cap the royalty rates through 2010 at 7.5% of revenue, what the satcasters currently pay. The CRB's decision would have increased the royalty fees for webcasters by between 300 and 1,200 percent. more>>

The satcaster announced that their first quarter increased 27 percent year over year to $264 million, narrowing their net loss year over year by 18 percent to $122 million. Said XM boss Hugh Panero, "During the quarter, we improved our retail performance, experienced strong OEM gross additions, extended our distribution agreements with Toyota and Honda, enhanced our customer service, maintained our churn rate at approximately 1.8 percent for the third consecutive quarter and strengthened key financial metrics for our business." While testifying before a Congressional committee Tuesday the Sirius boss said that his company is willing to commit to initial price caps, varying rate plans and rebates. According to FMQB , however the Carmel Group and the National Association of Broadcasters is continuing to contend that the merger would lead to "less service, less affordability, less diversity and less choice in content and hardware." more>>
The latest study by Arbitron and Edison Media Research indicates that consumers are continuing to explore digital radio while maintaining a broad use of traditional AM and FM radio.

The 8th U.S. Circuit Court of Appeals in St. Louis has affirmed a district court judge's decision to deny the satcaster's motion to dismiss. The lawsuit is over XM's claims that its music channels are commercial-free. Unfortunately broadcasting giant Clear Channel put an end to that (see RUsirius.com news archive story dated 9 March 2006) and market analysts have indicate that the trend would continue (see RUsirius.com news archive story dated 13 April 2006). Plaintiff Matthew Enderlin has been alleging that XM cannot claim commercial-free music because it is in violation of Arkansas' Deceptive Trade Practices Act and similar statues in 41 other states and the District of Columbia. He is seeking punitive damages and a court order that XM cannot advertise on channels it claims are commercial-free. more>>

S.Senate Committee on Commerce, Science & Transportation, highlighted the benefits of the proposed merger between Sirius and XM. Mel said the combined company would be able to offer consumers more choices at lower prices. He also said that satellite radio is just a small part of a highly competitive audio entertainment market and that the proposed merger would accelerate the deployment of advanced technology. The merger between the satcasters has come under sirius fire in the political arena, where decisions are expected from the Federal Communications Commission and the Department of Justice.

The XM affiliate has cut its losses by almost 40% in the second quarter. The company is turing its attention to correcting what some see as disappointing retail sales. Losses declined to 57 cents per share compared with $1.05 per share a year ago. Said president and chief operating officer Stephen Tapp, "While out holiday sales met our expectations, we're not happy with our retail performance to date." XM Canada posted a subscriber count of 237,000, up from 44,000 subscribers a year ago. more>>

Apparently a lot of money and the life of an industry. When the National Association of Broadcasters, working with iBiquity wanted to come up with something to compete with satellite radio they called it In-Band-On-Channel (IBOC), technically correct but not very exciting. Then they came up with HD Radio, a name much more evocative of the technology's capabilities. Speaking at NAB20007 in Las Vegas, NAB President & CEO David Rehr said, "When iBiquity used the term IBOC-In-Band-On_Channel Radio - no one, well, perhaps a few of us, had a clue what it meant. It is now known, thanks to some diligent bloggers, that the paper's author, Jimmy Schaeffler, had apparently contradicted himself. Several years ago he had said that the primary competition was between satellite and terrestrial radio, not between the satcasters. Opinions, it seems, are pretty easy to change if the price is right. more>>

The Ford subsidiary has announced that the satcaster's systems would be standard, factory-installed equipment on the 2008 Lincoln MKZ, Lincoln MKZ, Lincoln Navigator, Lincoln Navigator L and Lincoln Mark LT. Said Cisco Codina, Ford group president, North America Marketing Sales and Service, "Every day , Sirius Satellite radio is becoming more popular with our Ford, Lincoln and mercury customers because it allows them to personalize their driving experience."

In addition to funding studies and surveys critical of the Sirius/XM merger, the National Association of Broadcasters has apparently been funding the Consumer Coalition for Competition in Satellite Radio (C3SR).
